Victims of drunk drivers have claims not only against
the drunk driver, but also against the bar that served him/her.
Under the Texas Dram Shop Act, bars and restaurants must serve alcohol
in a responsible manner, and they can be held liable for the actions of
their intoxicated patrons. Their liability is not limited to drunk
driving (DWI or DUI) cases, but can include other harms caused by drunken bar
patrons.

Note: If you are concerned that you may be held liable for the actions
of houseguests, be aware that the Texas Dram Shop Act does not apply to
individuals who serve alcohol to social guests over the age of
twenty-one (21). The Act does apply, however, when guests are
required to pay for their drinks or a “cash bar” is provided at a social
